STATUTE GOVERNING SOCIAL PARTY IMBERAKURI (S.P. IMBERAKURI)
The General Constituent Assembly of Social Party IMBERAKURI, (S. P. IMBERAKURI)
Given that the Constitution of Rwanda recognizes many political parties,
Conscious of various problems which face the country even if the Government of Rwanda tries its best to resolve some of them,
Being aware that the country needs any active participation for its development,
Considering that the development of Rwanda relies on contradictory debates through various political parties,
Gathering at Kigali on 7th June 2009 Deciding to form the Social Party IMBERAKURI, (S.P. IMBERAKURI) as governed by the following Statute:
It is formed a Political Party named “Social Party IMBERAKURI, S. P. IMBERAKURI” as its acronym. In the following provisions it is named “PARTY”.
The motto of the Party is Justice, Love and Labor.
The flag of the Party is a rainbow drawing on a clear white tissue. It signifies that the three components of Rwandese people must work together in transparency.
The Party is identified by the seal of a rose between four fingers with thumb stays straight. It signifies mutual love and peace between Rwandese.
The head of the Party is established in the Bibare Cell, Kimironko Sector, Gasabo District, Kigali City, the capital of Rwanda. It can be transferred elsewhere in accordance with the decision of 2/3 of the National Council members.
The objectives of the Party are:
1. To improve Rwandan welfare and strive on sharing the country’s wealth in equal manner;
2. Striving on promoting the middle class of Rwandan people and fight against the bridge between Rwandese welfare where some become richest and other become poorest;
3. To promote the culture of contradictory debates on the management of national properties and hence having contrary views with the Government should not be considered as rebellion;
4. To respect and to save human rights;
5. To fight against hunger by promoting agriculture;
6. To develop the national economy through services, small scale and medium enterprises;
7. To fight against any cause of exile,
8. To strive on having an independent judiciary system which doesn’t delay in handling people’s cases.
THE PARTY MEMBERS
CATEGORIES OF MEMBERS
All Party members are equal and have the same rights and obligations. They are classified in two categories:
the effective members,
the member of honour.
The Internal Rules and Regulations define the difference between those members.
ADMISSION, IDENTIFICATION, RESIGNATION AND EXCLUSION
Any person intending to be the member of the Party has to fulfill the following:
1° to be Rwandese;
2° to have the required age to elect according to the law governing the matter;
3° to have no obstacle for joining the Party;
4° to be in compliance with rules of the Party
Any person intending to be the member of honour has to be in compliance with the requirements mentioned in article 8 but it is not necessary to be Rwandese.
The member of the Party must be registered on the list of members in the books kept in the office of the Party; and after the member is given a card signed by the President of the Party at National level. This card is an identification card of the member which permits him/her to have the rights as recognized by the Statute and Regulations governing the Party. The internal rules and regulations explain how this process must be done.
The resignation of the member is declared in writing or by public declaration made before the organ under which he/she is depended.
When the member of the Party is not in compliance with the regulations governing the Party or when he/she makes any offense, the Party may dismiss him/her depending on the seriousness of the violation proved.
Notwithstanding article 47, the dismal of the President of the Party is decided by the extraordinary National Congress convened for that purpose as requesting in written by ¾ of the members of National Congress.
Before taking this decision, the National Council requests him the written explanations in the letter written by the Deputy President.
RIGHTS AND OBLIGATIONS
The member has the following rights:
to have an identification card,
to be supported by the Party for eligible posts,
to be protected by the Party if need be,
to speak and to express his ideas in meeting.
The member is required to:
to give contributions as required by the regulations governing the Party,
to be honest,
to protect the interests of the Party,
to protect the member of the Party,
to attend meetings organized by the Party.
THE ORGANS OF THE PARTY
The Party has two main organs:
Organs on roots level,
Organs on national level.
ORGANS ON GRASS ROOTS LEVEL
The organs on grass roots level are Cell, Sector and District.
The Cell is the organ of the Party operating within the Cell. The organs operating within the Cell are the General Assembly of the Cell and the Committee of the Cell.
The General Assembly of the Cell is the superior organ of the Party in the Cell. It gathers all members of the Party who are people of the Cell.
The General Assembly of the Cell holds meetings once in two months. It may hold extraordinary meetings any time if need be.
The Committee of the Cell is the organ of the Party in charge of the Party’s management in the Cell. The Committee of the Cell is made up of the President, Vice President and the Secretary elected for two years by the General Assembly of the Cell.
The Committee of Cell holds meeting once in one month and any time if need be. The Committee of Cell is in charge of:
representing the Party,
sensitizing of the Party ideology on the Cell level ,
The organ of the Sector is the organ of the Party operating within the Sector level. It is managed by two organs which are the General Assembly and the Committee of the Sector.
The General Assembly is made up of:
The member of the Committee of the
The member of the Committee of Cell,
The elites who are members of the Party living in the Sector.
The General Assembly of the Sector holds meetings once in two months. It may hold an extraordinary meeting if need be. It is in charge of:
following up the management of the Party in the Sector,
electing the Committee of Sector and giving them directives,
Supervising all Cell organs.
The Committee of the Sector is the organ which keeps on the management of the Party in the Sector. It holds meetings once in a month and is made up of:
The Committee of the Sector is elected for three years by the General Assembly of the Sector. Its members can be reelected but once.
The Committee of the Sector is in charge of:
following up all Party’s activities in the Sector;
putting in practice directives from the General Assembly of the Sector;
representing the Party in meetings convened by administrative entities of Sector;
being a link between organs of Cell and organs of District.
The organs of Districts are the District Council and the Committee of District.
The District Council is made up of:
the Committee of District,
the Committee of Sector,
the Presidents of the Committees of Cell
The District Council is the organ which
Takes decision on the District level. It holds meetings once in two months and any time if need be. The District Council is in charge of:
supervising the management of the Party in the District,
supervising the Committee of District,
electing the Committee of District,
giving directives to the Committee of District,
making sure on the implementation of the Party’s decision,
electing the representatives of the Party for eligible posts.
The Committee of District is the organ which is in charge of the Party’s management in the District. It holds its meeting once in a month and any time if need be. It is made up of:
The Vice President,
The Committee of District is in charge of:
being a link between the grass roots organs and the national organs,
receiving contributions from members of the District,
registering the members of the Party in the District,
representing the Party in the administrative entities of the District,
recruitment of members especially from the opinion leaders living in the District.
The members of the Committee of District are elected for three years. They can be reelected but no more than once.
ORGANS OF NATIONAL LEVEL
The organs of national level are Management Committee, High National Council and National Congress.
The Management Committee is the superior organ in charge of the management of the Party on national level.
It is made up of:
1° President who is the legal representative and the spokesman of the Party;
2° Deputy President who is committed to assure that the ideals of the Party are in compliance with its ideology and its objectives. Deputy President replaces the President when he/she is not around;
3° Executive Secretary who is in charge of monitoring all activities;
4° Treasurer who keeps on financial resources;
5° Secretary in charge of Gender and youth.
The management Committee holds meetings once in a month and any time if need be. The President of the Party on national level is the chairman of the Management Committee meetings. In absence of the President, the Deputy President presides the meeting. Invitations must arrive to the members of the
Committee at least two days before the day of meeting.
The members of Management Committee are elected by the National Congress for five years; but they can be reelected many times. The internal rules and regulations determine conditions for the member to be in the Management Committee.
The High National Council is the organ which is committed to assist the Management Committee.
It is made up of:
1° members of Management Committee;
2° five advisers nominated by the Management Committee;
3° president of the National Disciplinary Committee;
4° three representatives from each Province elected by the Committees of District;
5° all Presidents of the Committee of District.
The High National Council is in charge of:
preparing the National Congress meetings,
approving the budget,
designing the ideals of the Party,
approving the Internal Rules and Regulations,
advising the Management Committee.
The High National Council holds meetings once in two months and any time if need be in extraordinary meetings. It is chaired by the President of the Party on national level. In its absence it is chaired by the Deputy President but he/she must have a written mandate issued by the President and this situation should be reported to the High National Council members at least two days before the day of meeting.
The National Congress is supreme organ of the Party which decisions should be followed by each member all over the country. It is made up of:
1° Members of the High National Council;
2° all deputy presidents and executive secretaries of the districts.
The National Congress is in charge of:
approving the ideals of the Party,
adopting and modifying the Statute of the Party,
Electing the management committee,
designing the candidate for presidential elections.
The National Congress holds meetings once in fifteen months and any time (extraordinary meetings) if need be in. The National Congress meeting is chaired by the President of the Party on national level. The participants in the National Congress meeting must have an invitation signed by the President of the Party on national level.
The organ in charge of Mediation and Conflict Resolution is the organ which has the responsibility to solve all conflicts either in internal party or in external with other political parties.
At the National Level, it made of four people including at least one woman.
At the grass root levels, there are members in charge of mediation and conflict resolution who help the committees when it needed.
The members who are elected for mediation and conflict resolution come from opinion leaders of the party.
The members of the organ of mediation and conflict resolution are elected for six years renewable.
The meetings of this organ are convened and chaired by its Chairperson every three months and any time the need arises.
The organ in charge of mediation and conflict resolution has the following responsibilities:
To advise executive committee.
To watch the behavior of executive committee,
To watch the behavior of the members of the Party,
To make a follow up to a member who has mistaken and to punish him/her if it is necessary,
To make a mediation with another political organization when necessary according to the laws and regulations,
To prevent the crimes,
To explain the laws and regulations to members of the Party,
To hold meetings and give the reports to Executive Committee.
GENERAL PROVISIONS FOR ALL ORGANS
Article 46 :
Before taking office, the representatives of the Party must take the oath before the organ which has elected them in these words I……………, swear to the Social Party IMBERAKURI, S.P. IMBERAKURI that I shall fulfill my duties, remain loyal to the ideals of the Party, observe the Statute and other rules of the Party and commit to promote my Party and my country.
The meetings of the Party are convened by the President of the organ subject to hold a meeting. The Presidents of the Committees are Presidents of organs which have elected them. The ordinary meetings are convened at least fifteen days before the date of meeting and the extraordinary meetings are convened at least five days before the day of the meeting.
The quorum required for each organ is at least the absolute majority of its members. If this quorum is not reached, the other meeting is convened within fifteen or five days according to article 46. In that case, the meeting takes place and all members are bound by decisions taken.
In the event of absolute impossibility of the Chairperson of the Party at national level, he/she is replaced by the Deputy President until the end of the mandate of the outgoing president. The other members are replaced by those who are elected by the involved organ in the meeting convened by the President. In the event of absolute impossibility of the member of Management Committee this one is replaced by the one who is elected by the High National Council and he/she must finish the mandate of outgoing member.
PROPERTIES AND FINANCIAL RESSOURCES OF THE PARTY
The properties and financial resources of the Party are generated by:
contributions from the members of the Party,
gifts and legacy,
The contributions of the members are determined by the Internal Rules and Regulations.
The High National Council approves the budget adopted by the Management Committee.
OFFENSES AND SANCTIONS
The sanctions are determined according to the seriousness of the offense. Those sanctions are:
to be dismissed from the management of the Party;
suspension for the period of one year,
The sanctions mentioned above are taken by the organ which has elected the offender after the inquiry carried out by the Disciplinary Committee.
The Internal Rules and Regulations determine the functioning of the Disciplinary Committee. They determine also the modalities and effects of disciplinary sanctions.
FINAL AND TRANSITIONAL PROVISIONS
In the event of absolute impossibility of National Congress its mission is carried out by High National Council.
This Statute can be modified by the decision of ¾ of the members of National Congress.
The Party can be dissolved by the decision of the National Congress convened for this purpose and this decision must be requested in writing by ¾ of the members of National Congress. The decision is taken by 2/3 of the members of National Congress who attend the session.
In the event of the dissolution of the Party its properties are given to any philanthropic Association designed by the National Congress. In that case no member can reclaim what he/she has given to Party.
This Statute came into force on the day of its adoption by the Founder Members of the Social Party IMBERAKURI, S.P. IMBERAKURI in the first General Assembly at Kigali, on 07/06/2009 ; It was revised by the National Congress of S.P.IMBERAKURI held at Kigali, on 28/08/2011; It was revised and adopted by the National Council of S.P. IMBERAKURI held on 08/08/2013.
